Mr. Cohen is considered a senior statesman in the Intellectual Property Bar. He has been lead counsel in over 200 civil actions involving patents, trademarks or copyrights. He has successfully briefed and argued appeals in the Courts of Appeals for the Second, Third, Eleventh and Federal Circuits. His practice includes all aspects of patent, trademark and copyright law, with an emphasis on copyright and trademark law and related counseling, licensing and litigation. A frequent speaker, Mr. Cohen has lectured extensively on patents, trademarks and copyrights in the United States and Canada to both lawyers and business executives. He is registered to practice before the Patent and Trademark Office. Reeves Brothers, Inc. v. U.S. Laminating Corp., 282 F. Supp. 118, 157 USPQ 235 (E.D. N.Y. 1968), aff'd, 417 F.2d 869 (2d Cir. 1969). The district court held that two patents on the lamination of foam to fabric, for which there had been 67 licensees, were invalid and not infringed. The decision was affirmed on appeal.

J & D Home Improvement, Inc. v. Basement Doctor, Inc., 70 USPQ2d 1250 (3d Cir. 2004). The district court dismissed an action seeking concurrent use registrations, on a motion to dismiss for lack of subject matter jurisdiction, and the decision was affirmed on appeal.

In re N.A.D. Inc., 754 F.2d 996, 224 USPQ 969 (Fed. Cir. 1985). The Court of Appeals for the Federal Circuit reversed the decision of the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, and ordered a trademark to be registered, based on a consent to use and register from the prior registrant.

Jellibeans, Inc. v. Skating Clubs of Georgia, Inc., 212 USPQ 170 (N.D. Ga. 1981), aff'd, 222 USPQ 10 (11th Cir. 1983). The district court found that the service mark LOLLIPOPS infringed on the service mark JELLIBEANS, for roller rink services, and this decision was affirmed on appeal.

Alexandria Drafting Co. v. Amsterdam, 43 USPQ2d 1247 (E.D. Pa. 1997) (opinion vacated, pursuant to settlement agreement). The district court found that a map did not infringe on the Plaintiff's copyrighted map, on the basis that the mere drawing of lines on paper, to replicate streets, did not constitute copyrightable subject matter.

M.S.R. Imports, Inc. v. R.E. Greenspan Co., Inc., 220 USPQ 361 (E.D. Pa. 1983), aff'd, without opinion, 732 F.2d 146 (3d Cir. 1984); see also, 574 F. Supp. 31, 225 USPQ 585 (E.D. Pa. 1983). The district court found the copyrights on metal sculptures were valid and infringed, and awarded maximum statutory damages and counsel fees. The decision was affirmed on appeal.
